Incident Details: On 15th August 2022, Tottenham resident Mahmut Emanet took his company vehicle to Silver Street Service Garage for servicing. The company director, Mr. Seyit Dilek, committed a grave oversight by leaving Mr. Emanet beneath the vehicle while it was raised on a vehicle lift. Tragically, the vehicle fell off the lift, resulting in Mr. Emanet sustaining serious crush injuries.
Health and Safety Concerns: The Health and Safety Executive (HSE) inspector emphasised that Mr. Emanet was “lucky to be alive” after spending six days in a critical care unit. The incident underscores the broader risks associated with poorly supported vehicles in the motor vehicle repair industry. Shockingly, recent statistics reveal that 24 workers in this industry lost their lives in work-related accidents over the last five years, with a fatal injury rate five times higher than the industry average.
HSE Investigation Findings: The investigation found serious lapses on the part of Silver Street Service Garage Limited. The company failed to ensure that members of the public, like Mr. Emanet, were not exposed to health and safety risks. Additionally, the equipment used in the garage was not thoroughly examined for defects. Mr. Seyit Dilek, as the director and in control of the garage, neglected his responsibility to manage access and work conduct, leading to the tragic incident.
Legal Consequences: Silver Street Service Garage Limited pleaded guilty to breaches of Section 3(1) of the Health and Safety at Work etc. Act 1974 and Regulation 9(3)(a)(ii) of the Lifting Operations and Lifting Equipment Regulations 1998. The company faced a £12,000 fine and additional costs. Mr. Seyit Dilek, individually responsible for the incident, pleaded guilty to a breach of Section 3(1) and received a £500 fine along with costs.
