In a devastating incident on August 11, 2021, a garden landscaper’s negligence resulted in the death of a worker. The labourer, who had only been on the job for two days, lost his life when a moving circular saw kicked back into his groin at a house in Harewood, Rickmansworth.
The 31-year-old worker was assisting Mr. Fernando Araujo, a 54-year-old gardener based in Watford, with the installation of railway sleepers along the front garden driveway. The use of a toothed circular saw blade on an angle grinder, lacking a guard, made the machine dangerous. Tragically, the worker sustained a serious, fatal laceration when the unsecured sleeper was being cut.
Mr. Fernando Araujo, acknowledging the breach of safety regulations, pleaded guilty to charges brought forward by the Health and Safety Executive (HSE). He was sentenced to six months in prison, suspended for two yearsand ordered to complete 200 hours of unpaid work. Additionally, he must pay £3,467.72 in costs.
The District Judge recognised that no sentence could compensate for the family’s loss, emphasising the irreplaceable value of a life. HSE inspector Jenny Morris stressed the importance of using power tools safely and selecting the correct equipment for the job.
