Protected characteristic – Gay and potential stress / anxiety.

A Gentleman was on a night shift in a care home, two witnesses reported him attending work under the influence of alcohol – leaning on tables and then falling over – reported he was not in a fit state to look after the residents. His speech was slurred, and he was flamboyantly stating in a former role he was an exotic dancer. When one of the witnesses confirmed to him, they would be reporting the matter to management, the gentleman then threw a dirty incontinent pad at him. Thank fully this was recorded on CCTV.

The result – Full Investigation followed by a Disciplinary – resulting in Dismissal for Gross Misconduct. Reported to CQC.

16 / 17 years long service – No protected characteristics

During a late shift the two ladies were accused of both physically and verbally abused it was reported that by a fellow colleague specifically shouting at the residents, placing their hands over a dementia resident mouth due to the lady shouting frequently. Saying cruel and hurtful things to residents to upset them and eating resident’s food which contained medication resulting in one of these ladies being drowsy for the rest of her shift.

The result – a Full Investigation was carried out and during the Disciplinary Process the two resigned however, both were reported to CQC.
